§ 1 Scope & Provider
(1) These Terms of Service (hereinafter "Terms") govern the contractual relationship between TruthPush, Owner: Timo Gertheiss, Lessingstr. 68, 76135 Karlsruhe, Germany (hereinafter "Provider") and the users (hereinafter "Customer") of the TruthPush service.
(2) Deviating terms and conditions of the Customer shall not apply unless the Provider has expressly agreed to their validity in writing.
§ 2 Scope of Service & Technical Limitations
(1) Service (News Ticker): TruthPush operates as a technical aggregator and digital reading aid for publicly available data sources. The Provider provides technical infrastructure that queries defined, public profiles on the "Truth Social" platform at short intervals ("polling") and presents newly detected text content ("posts") in a unified feed ("Live Ticker").
(1a) Eligible profiles: Only public profiles on Truth Social with at least 1,000 followers may be monitored. Private, deleted, or profiles below this threshold are excluded from the scope of service.
(2) No Archiving: The service is expressly not an archive or a database for the permanent storage of third-party content. The scope of service is limited to the transient transmission of current information ("Breaking News Character").
(3) Definition "Real-Time", Upstream Latency & AI Processing
We guarantee transmission within the timeframe specified in the tariff from the moment of technical
detection by our systems on a best-effort basis.
Risk Notice: The Customer acknowledges that third-party platforms (Truth Social) often
serve content with a delay (CDN caching). A post may carry a timestamp that predates its actual public
visibility on the internet. The Provider assumes no liability for this "upstream latency". Minor system-internal latencies (e.g., due to AI processing) may occur and are expressly reserved. For posts consisting exclusively of media content (without extractable text), no sentiment analysis is performed; this does not constitute a defect in service.
(4) Retention Period & Deletion: To protect third-party copyrights and ensure the character of the service as a pure news ticker, content (text, metadata) is only stored temporarily. All content is automatically removed from the customer's live access 24 hours after detection. There is no entitlement to access historical data older than 24 hours within the standard scope of service.
(5) Availability, Maintenance & Completeness: The Provider provides the service on a "best-effort" basis. Continuous, uninterrupted availability is not guaranteed. In the event of changes to interfaces, IP blocks (rate limiting), or outages of Truth Social, as well as unforeseen server outages (e.g., at the hosting provider) or necessary, brief maintenance windows for system updates, the Provider is released from the obligation to perform for the duration of the disruption. The Provider employs technical filters to suppress duplicates and spam; therefore, there is no claim to uninterrupted completeness of all posts from a profile.
§ 3 Conclusion of Contract & Payment Processing
(1) The contract for paid subscriptions is concluded directly with the Provider (TruthPush).
(2) Payment processing is handled by the payment service provider Stripe. The Customer agrees that the data necessary for payment processing will be transmitted to Stripe. The Terms of Use of Stripe apply in addition.
(3) Prices & VAT: All prices shown on the website are final prices in EUR. Pursuant to § 19 para. 1 German VAT Act (UStG), no VAT is charged or shown (small business regulation).
§ 4 Disclaimer: Financials & Trading (IMPORTANT)
(1) No Financial Advice
The transmitted data is for information purposes only. It does not constitute investment advice, a recommendation to buy, or a solicitation to trade financial instruments.
(2) Exclusion of Liability for Financial Losses
The Provider is not liable for financial losses (e.g., trading losses, lost profits) incurred by the Customer due to the use, non-use, delay, or incompleteness of the transmitted messages. Trading in financial markets is at the Customer's sole risk. Technical disruptions (e.g., failure of the Telegram API) do not constitute a claim for damages for missed market opportunities.
(3) AI Analyses and Sentiment Scores
The sentiment analyses (e.g., Bullish, Bearish) and extracted keywords provided on the platform are generated automatically by artificial intelligence (AI) models. The Provider expressly assumes no liability for the accuracy, completeness, or market relevance of these analyses. The Customer uses these automated assessments at their own risk.
§ 5 Rights of Use & Abuse (Anti-Scraping)
(1) Access is personal and non-transferable. Sharing access credentials with third parties ("Account Sharing") is prohibited.
(2) Prohibition of Reselling/Scraping: The Customer is prohibited from automatically extracting (scraping), reprocessing, or reselling the real-time data received from the Provider as their own feed to third parties ("Reselling").
(3) In the event of a violation, the Provider is entitled to block access immediately and without refund.
§ 6 Term & Termination
(1) The subscription runs for an indefinite period and renews automatically for the chosen period (month/year).
(2) Termination is possible at any time effective at the end of the current billing period. It is managed via the Customer Portal of the payment service provider Stripe (linked in the account section).
§ 7 Liability (General)
(1) We are liable without limitation for intent, gross negligence, and injury to life, body, or health.
(2) In cases of slight negligence, we are only liable for the breach of essential contractual obligations, limited to the foreseeable damage typical for this type of contract.
§ 8 Third-Party Services
(1) To provide our service, we use carefully selected third-party providers, in particular for hosting (Hetzner Online GmbH), payment processing (Stripe), email delivery (Brevo), bot protection on registration (Cloudflare Turnstile), AI-assisted content analysis (OpenAI), and — if activated by you — alert delivery via Telegram.
(2) Where required by law, we have concluded data processing agreements with processors. Details on the processing of personal data, legal bases, retention periods, and your rights are set out in our Privacy Policy.
§ 9 Final Provisions & Governing Language
(1) German law applies. The place of jurisdiction is Karlsruhe, Germany.
(2) Governing Language: The German version of these Terms shall be binding. This English translation is provided for convenience only. In the event of any discrepancies, the German text shall prevail.
